Overview

The New York State Cannabis Control Board is the approval and oversight body of the Office of Cannabis Management. The Board is responsible for approving the comprehensive regulatory framework for New York's cannabis industry, including issuing applications and licenses to cannabis businesses and approving the rules and regulations which will govern the new industry.

Board Authority

The Cannabis Control Board is responsible for creating and implementing a comprehensive regulatory framework for medical and adult-use cannabis and hemp in the State of New York. 

In accordance with Cannabis Law Section 10, the Board’s functions and duties include, but are not limited to the following: 

  • discretion to issue or refuse to issue any license, registration, or permit;
  • discretion to revoke, cancel or suspend for cause any registration, license, or permit issued and/or to impose a civil penalty;
  • issue regulations, declaratory rulings, guidance and industry advisories;
  • issue subpoenas and administer oaths in connection with any hearing or investigation;
  • enter into contracts, memoranda of understanding and agreements;
  • appoint the Chief Equity Officer;
  • and appoint advisory groups and committees as necessary to assist the Board in carrying out its duties. 

Membership

The Board consists of five (5) board members, including the Chair. 

  • The Chair shall be nominated by the Governor with advice and consent of the State Senate.
  • The Governor shall have two additional direct appointments to the Board.
  • The Temporary President of the Senate shall have one appointment to the Board.
  • The Speaker of the Assembly shall have one appointment to the Board. 

Appointments shall be for a term of three years each.
 

Board Payment Structure

Under Cannabis Law Section 7(2), “the members, except for the chairperson, shall when performing the work of the board, be compensated at a rate of two hundred sixty dollars per day, and together with an allowance for actual and necessary expenses incurred in the discharge of their duties. The chairperson shall receive an annual salary not to exceed an amount appropriated therefore by the legislature, and their expenses actually and necessarily incurred in the performance of their official duties, unless otherwise provided by the legislature. No member or member's spouse or minor child shall have any interest in an entity regulated by the board.”
